Tillslag mot Piratebay

Expressen, Aftonbladet och Svenska Dagbladet rapporterar om ett tillslag mot Piratebay idag. Det som upprör mig allra mest är att Rasmus Fleischer verkar ha bytt sida :):

– Vid tidigare tillslag har man haft konkreta fall av nedladdning att gå på, här handlar det nog mer om att polisen vill störa verksamheten, säger Rasmus Fleicher på organisationen Antipiratbyrån till SvD.se.

Uppdatering: Tråkigt… de upptäckte misstaget. Nu står det Piratbyrån istället.

Jag hoppas att Piratebay inte kommer gå under för att man till exempel använder några jpeg-bilder utan tillstånd. För det nämns ju ingenting om att det skulle vara på grund av torrenttrackern som tillslaget skett. Vi får väl se vad som kommer fram om en stund.

ThePirateBay.org Raided – Servers Seized

In their native Sweden, ThePirateBay.org enjoyed a level of immunity from copyright prosecution rarely seen in the file-sharing world. Often defiant in the face of those wishing to enforce their intellectual property rights, ThePirateBay.org would go on to become one of the premier BitTorrent indexing and tracking sites.

As one of the largest trackers, ThePirateBay.org largely replaced the search engine SuprNova.org. SuprNova.org met its demise in late 2004, when it was under pressure from the entertainment industry to shut it operation down. Conversely, such pressure has been ineffective against ThePiratebay.org.

When such political pressure fails, the use of force is typically the next course of action. In a move that many thought would never come, Slyck.com learned this morning that ThePirateBay.org was raided by Swedish police.

“…The police right now is taking all of our servers, to check if there is a crime there or not (they are actually not sure),” ThePirateBay.org spokesperson “brokep” told Slyck.com.

The seizure of ThePirateBay.org’s entire server farm will guarantee this BitTorrent tracker will remain offline until the police complete their investigation. The uncertainty on the part of the police may stem from the fact ThePirateBay.org’s servers only host .torrent files, not actual copyrighted material. As a tracker, ThePirateBay.org’s function is to index .torrent files and to direct BitTorrent traffic and maintain the swarm (uploads and downloads.) The downloaded .torrent file contains all the necessary information to locate and download the queried file. The legality of indirectly linking to copyrighted material has yet to be tested by Swedish courts.

Whether this will keep ThePirateBay.org offline indefinitely is another matter.

“We are not sure when it will return, but we are moving it to another country if necessary,” brokep said.

According to The Pirate Party, a Swedish copyright reform organization, the raid also seized Piratbyrån’s (the Pirate Bureau) servers. Piratbyrån is a educational and quasi-political organization which performs a public servic role similar to The Pirate Party. In addition, The Pirate Party reports ”…the servers where located in a protected area, to which the police had no legal right to enter…” Approximately 50 police participated in the raid, which placed into custody two PirateBay.org personnel.

The premature departure of ThePirateBay.org marks a significant turning point in the BitTorrent community. Although it’s not currently known what, if any, entertainment entity is behind this raid, failure to secure ThePirateBay.org’s permanent removal will only bolster this tracker’s position of defiance.

Storebror säljer nakenbilder

Svenska Dagbladet rapporterar om att anställda hos polisen i Newcastle med hjälp av de många övervakningskamerorna har tagit närbilder på nakna människor som var med i ett verk av konstnären Spencer Tunick. Dessa har sedan sålts på olika pubar.
Men har man inget att dölja behöver man inte vara orolig, så det är bara att låta poliserna sätta upp fler kameror. Några terroristattentat har inte rapporterats under det aktuella tillfället iallafall, så kamerorna fyller sin funktion.

Australien förbjuder graffiti-dataspel

The Classification Review Board i Australien har förbjudit försäljning, demonstration, uthyrning och import av Marc Ecko’s Getting Up: Contents Under Pressure.

The decision was endorsed last night by the Federal Attorney-General, Philip Ruddock, who had asked the board to review of the game’s MA15+ classification after local councils and state governments voiced concerns that the game would promote graffiti.

Det ironiska är att spelet utspelar sig i en framtid där yttrandefrihet saknas, och graffiti är det enda sättet att få fram sina åsikter. Och varför förbjuds dataspel, men inte filmer eller böcker?

The President of the NSW Council for Civil Liberties, Mr Cameron Murphy, described the basis of the ban as ””ridiculous”.
”We don’t ban films that include criminal activities – we would not see The Godfather if this policy was in place with films.” he said. ”The problem is clearly the Classification Review Board does not understand the technology.”

Mr Ecko: ”If a kid wants to learn how to write on the wall, he or she will figure it out. They have done it since prehistoric times, in fact.

Bodström tycker inte ökad övervakning hotar integriteten.
Jinges banner och att Oscar Swartz myntade uttrycket Bodströmsamhället nämns.
Bodström får kritik från flera håll, både statsvetare och jurister. Thomas själv förstår inte varför.

Uppdatering: Nu har jag sovit, varit på föreläsning, och jobbat.

Efter att jag läst en ny artikel hos Computer Sweden så har jag svårt att se hur Thomas Bodström kan säga att hans förslag inte är integritetstänkande. Tidigare så har jag tänkt att han kanske bara är naiv och inte ser konsekvenserna, men om man ska kunna få ut de uppgifter som finns lagrade om en person (som en konsekvens av datalagringsdirektivet) för misstankar om varenda brott som kan ge böter (i princip alla brott. Finns det något som faller utanför?) så har jag svårt att se hur han inte ljuger. Nu är det inte ens bara de som är misstänkta för grova brott som ska övervakas, något som går emot det som Thomas Bodström sagt tidigare.

T ex:

Vanliga oskyldiga behöver inte vara det minsta oroliga, hävdar han.

– De vars integritet kommer att kränkas är de som begår brotten. Men dem vill vi ju sätta i fängelse.

Sätt de som döms till böter i fängelse, så kan jag gå med på det. Då ljuger han inte längre, men det blir många som får sitta inne då.

RIAA/MPAA vill förbjuda teknisk innovation

EFF berättar att RIAA och MPAA vill ha möjlighet att stoppa alla nya uppfinningar som skulle kunna användas för piratkopiering.

Well, that’s not what the entertainment industry has in mind. According to them, here’s all tomorrow’s innovators should be allowed to offer you:

”customary historic use of broadcast content by consumers to the extent such use is consistent with applicable law.”

Had that been the law in 1970, there would never have been a VCR. Had it been the law in 1990, no TiVo. In 2000, no iPod.

Via Washington Post fick jag reda på att Sony BMG har nått en uppgörelse i en grupptalan som förts mot dem i New York. De kom rätt billigt undan. Se Sunbelt BLOG för detaljer. I princip så går det ut på att de slutar sälja skivor med XCP- eller MediaMax-skydd, erbjuder kunderna ”rena” skivor och lovar att inte använda information insamlad från kunder till att vara elaka.

Legaliserad fildelning i Frankrike

Har inte hunnit läsa artikeln än, men enligt Slashdot har Frankrikes parlament röstat igenom ett lagförslag om att tillåta fildelning av film och musik på internet. Mer om detta snart.

Uppdatering: Enligt Bloomberg.com rör det sig om ett tillägg till en lag om immateriell egendom.

The amendment, which is attached to a bill on intellectual property rights, states that ”authors cannot forbid the reproduction of works that are made on any format from an online communications service when they are intended to be used privately” and not for commercial use.

Förslaget röstades igenom med 30 röster för och 28 mot. På grund av att röstningen gjordes sent på kvällen var resten av de 577 ledamöterna frånvarande. Allt är dock inte vunnet än:

The government can overturn the amendment, either by re- opening debate or if the Senate votes it down when the bill moves to the upper house. French Culture Minister Renaud Donnedieu de Vabres has asked that parliament re-open debate on the amendment today, Agence France Presse reported.
